Pappe, an Israeli historian and a senior lecturer at Haifa University, has written a superb account of the Israeli expulsion of the Palestinians from their land in 1948. He says that between 30 March and 15 May 1948, i.e. before any Arab government intervened, Israeli forces seized 200 villages and expelled 250,000 Palestinians. The Israeli leadership stated, "The principal objective of the operation is the destruction of Arab villages ... the eviction of the villagers." On 9 April, Israeli forces massacred 93 people, including 30 babies, at Deir Yassin. In Haifa, the Israeli commander ordered, "Kill any Arab you encounter."
Overall, the Zionist forces uprooted more than half Palestine's population, 800,000 people, destroyed 531 villages and emptied eleven urban neighbourhoods of their inhabitants. Pappe concludes that this was "a clear-cut case of an ethnic cleansing operation, regarded under international law today as a crime against humanity."

The Return - Exhibition and Film Screening

On Friday August 17, 2007 The Freedom Theatre, Birthright Unplugged and Voices Beyond Walls present a photography exhibition and film screening, The Return, at The Freedom Theatre in Jenin Camp.

Three projects are being presented at this event. Children who took part in a Birthright Unplugged trip to Jerusalem, Haifa and surrounding villages present photographs they took during the visit, while the young participants of a recent video documentation project, Dreaming in Palestine (organised by Voices Beyond Walls) present their short films.

The third project being presented is a creative writing and photography project called Refuge. Works produced during this project have been compiled into a book and are now being presented in the form of a photography display and poetry reading.

This documentary short film brings the viewer close to the conditions isolating Palestinians within their communities. It is filmed next to the separation barrier that Israel continues to build in the occupied Palestinian territories.

Terry Boulatta, mother, teacher and community activist, shows how the 27 foot high wall surrounds her neighborhood in East Jerusalem, dividing it from the adjacent community of Abu Dis, severing the historical bonds of the two communities. The wall contributes to the suffocation of life, the latest reality for Palestinians under occupation.

Terry takes us on a half hour drive to get from one side of the wall to the other, a trip that previously took only four minutes. We learn of the terminals and checkpoints through which Palestinians must pass to travel within their own territory.

Terry speaks of the illegal settlements and land confiscations as elements of apartheid, making the settlers "the masters of the land."

Pippo Inzaghi struck twice as AC Milan gained revenge for their 2005 Champions League final defeat against Liverpool with victory in Athens.

Inzaghi scored a freak opener in first-half injury time, unwittingly deflecting Andrea Pirlo's free-kick past a wrong-footed Pepe Reina.

Steven Gerrard missed a glorious chance to equalise before Inzaghi slid home a second eight minutes from time.

Dirk Kuyt pulled one back with a header with a minute left, but time ran out.

Liverpool, as expected, used Kuyt as a lone front man with captain Gerrard pushed into an advanced role.

And it was a ploy that worked well until Liverpool conceded unfortunately in the dying seconds of the first half.

Jermaine Pennant was also prominent as Liverpool posed the greater threat, forcing a fine save from Dida after Marek Jankulovski had conceded possession.
he much-touted Brazil star Kaka was a peripheral figure early on, but he brought a comfortable save from Liverpool keeper Reina with a 20-yard drive.

Alonso then came within inches of putting Liverpool ahead after 26 minutes, sending an angled drive just wide after more poor Milan defending.

But after controlling the game, Liverpool conceded needlessly in first-half injury time.

Alonso had committed several careless fouls, and he paid the price for another infringement on Kaka 20 yards out.

Pirlo's free-kick took a crucial deflection off Inzaghi that completely wrong-footed Reina.

Liverpool struggled to exert their superiority in the early stages of the second half and Benitez made a change after 58 minutes, sending on Harry Kewell for Bolo Zenden.

Gerrard had Liverpool's best chance on 62 minutes when he was sent clear by a dreadful pass by Rino Gattuso, but his finish was weak and Dida saved.

Time was running out for Liverpool and Benitez made a second change with 13 minutes left, sending on Peter Crouch for Javier Mascherano.

As Liverpool pushed forward, they were punished by a piece of brilliance by Kaka and a trademark ruthless finish from Inzaghi.

Kaka unlocked Liverpool with a glorious pass and Inzaghi rounded Reina before scoring from an angle.

Crouch then tested Dida with a 25-yard drive as Liverpool tried to mount an unlikely recovery.

Liverpool pulled one back in the dying seconds when Daniel Agger flicked on Pennant's corner and Kuyt headed home.

But this time there was no dramatic comeback and Milan celebrated wildly.

Bil'in, Second anniversary demonstration. 23rd February 2007

This isn't by any means a documentary, nor is it an account of the valiant efforts of those who protest the Israeli occupation of Palestine, and the bad tempered wall that is being built.
Rather it is a narrative of the day, and an attempt to represent what I felt as a both a protester and witness to the demonstration.
Bil'in is a phenomenon of a sort, in that it is the only anti-wall demo that has built up any kind of momentum. It has built a reputation as a success story of the non-violent resistance movement in Palestine, despite controversy regarding the motives of some of the activists that attend the weekly protest (so-called "violence tourists"), the regular stone-throwing of local kids and even the extent to which local villagers would like to see these protests continue.
This was the second time I'd attended the protest, and both times I have been overwhelmed, not only by the ridiculously heavy-handed methods of the Israeli military (which is self-evident in the video), but also by the intangible atmosphere amongst the protesters.
Bil'in is unique in that it is no longer simply an anti-wall demonstration; it has become something of a public relations animal. A symbol of non-violent resistance to show to the world, regardless of the ground-level intentions and goals of the local people who essentially want to get rid of the illegal wall (or, if you will, security fence, blah blah blah), so that they can access their farmland.
I have a friend who is convinced (and I am persuaded) that Israel only permits "Bil'in" to continue, firstly as an excellent training arena for their vast amounts of inexperienced young soldier-boys, and secondly to give sheen to the illusion of permissive Israeli democracy. Although it is slightly self defeating to be smug about allowing non-violent protest when you violently dismantle it.
It is a weird event, made all the more weird by the hundreds of people that attended the second anniversary. I would guess that there was at least three cameras to every person.

What is medical malpractice?

Medical malpractice is the negligence of a doctor or other healthcare professional which causes injury or death.

The plaintiff in a medical malpractice case bears the burden of proving that the care rendered by a doctor or other healthcare professional failed to meet the applicable "standard of care". The "standard of care" represents the knowledge, skill and ability that an ordinarily careful professional would exercise under the circumstances. The plaintiff must also demonstrate that the failure of the healthcare professional was a cause of the damage suffered.

What is the statute of limitations for a medical malpractice claim?

Any action for personal injury or death against a physician or hospital must be filed within two years from the date the claimant knew or reasonably should have known of the injury. In no instance may a claimant bring an action more than four years after the date on which the alleged act or omission occurred.

If the claimant was under the age of 18 at the time of the alleged negligence the statute of limitations is tolled. A claim may be brought for injuries suffered by a minor within two years of their 18th birthday or within two years of the date on which the claimant knew or should have known of the alleged negligent act. In no event may such an action be filed after the minor claimant's 22nd birthday. If the claimant is mentally incompetent, the period of limitations does not begin to run until the disability is removed.

Wrongful death actions are governed by a two year statute of limitations that begins to run on the date of death. Wrongful death actions may be maintained only if, on the date of death, the decedent could still have commenced a malpractice action for the injury that caused the death.

How is medical malpractice litigation different than other personal injury cases?

In any medical malpractice case, the plaintiff's attorney must attach to the complaint an affidavit stating that (a) he has consulted with an expert who has practiced or taught within the last six years in the same area of medicine that is at issue; (b) the expert is qualified by experience or demonstrated competence in the subject of the case; and (c) the expert has determined in a written report, after review of the medical record and other relevant material, that there is a reasonable and meritorious cause for the filing of such action. A copy of the report must be attached, although the identity of the expert may be withheld.

The requirement that an affidavit and medical report must be filed with the complaint was first instituted in Illinois in 1986 to reduce frivolous lawsuits. This legislation requires an expert be involved in the review of records and any other materials before the litigation commences and any discovery may be taken. Although this results in more significant litigation costs initially, it provides insight into whether the plaintiff's case is meritorious.

How is the Attorneys fee calculated in a medical malpractice case in Illinois?

An attorney's contingent fee in a medical malpractice case is regulated by Illinois statute. The attorney fee in a medical malpractice case is structured as follows:

(a) 33 1/3% of the first $150,000.00 recovered;

(b) 25% of the next $850,000.00 recovered; and

(c) 20% of any amount over $1,000,000.00.

If the claimant's attorney performs extraordinary services involving more than the usual time and effort, the attorney may petition the court for additional compensation.

What expenses are associated with medical malpractice litigation?

The cost of litigation in addition to the contingent attorney fee must also be considered when evaluating a medical negligence claim. Significant litigation costs are typically involved in the prosecution of a medical malpractice case. Such costs include the charge for filing a lawsuit, serving the defendants with a copy of the lawsuit and summons, deposition transcripts, involvement of medical experts and travel for discovery purposes. It is not unusual for the costs advanced in a straightforward medical malpractice case against one physician to exceed $50,000.00 to $100,000.00.

What if the plaintiff was also negligent?

What if the plaintiff failed to follow a doctor's advice or otherwise did something that contributed to his injury or death? Under Illinois law, a claimant's action is barred if his comparative fault is found to be more than 50% of the cause of the injury or damage for which recovery is sought. If the amount of comparative fault is found to be less than 50%, the claimant's recovery is diminished in proportion to the percentage of fault. For example, if a jury awards $100,000.00 but finds that the plaintiff is 25% comparatively negligent, the jury award is reduced to $75,000.00.

What elements of damage may be recovered in a medical malpractice case?

Many of the same elements of damage that apply in other negligence cases apply in a medical malpractice case. In the case of someone's death, the next of kin can recover for the money, goods, services, love, comfort and companionship the decedent provided. Damages for pain and suffering, disability, loss of wages and the cost of additional medical care required are recoverable for injuries suffered. Whether such elements of damage apply in a specific medical malpractice case depends upon an assessment of the particular circumstances at issue.

Can a hospital be held liable for a doctor's negligence?

Under certain circumstances, a hospital may be liable for the conduct of doctors, nurses or other healthcare professionals that staff the hospital. If the hospital employs the physician, nurse or other healthcare provider, the hospital may be liable for their conduct. Whether the hospital is liable depends upon a careful review of the circumstances surrounding the employment status of the physician. Additional factors including method of payment, facilities provided, perception of the public and nature of the medical care rendered must also be assessed.

In addition to potential liability for the conduct of employees, hospitals may also be liable for the acts of non-employees under certain circumstances. For example, the hospital may be liable for granting privileges to an unqualified physician. A hospital may also be liable for inappropriately staffing the facility or failing to appropriately determine the professional competence of a physician before granting staff privileges. A hospital has a duty to make continuing assessments of its physicians' competence and the failure to do so may constitute negligence.

What about the medical malpractice "crisis"?

The subject of medical malpractice reform and "crisis" have received a great deal of media attention as of late. The past few years have seen a sharp increase in premiums for medical malpractice liability insurance, a product which hospitals require of their doctors to grant staff privileges. A Congressional Budget Office Report dated January 8, 2004 attributed an increase in insurance premiums to the growth in malpractice awards and reduced income from insurance company investments and short term factors in the insurance market.

A recent Chicago Tribune article cited anecdotal evidence that many doctors are leaving the practice of medicine in the State of Illinois because of their malpractice premiums. The General Accounting Office investigated this issue in five states with reported access problems and found reduced access to emergency surgery and newborn delivery "in scattered, often rural, areas where providers identified other longstanding factors that affect the availability of services." The GAO report concluded that many reported reductions in supply by healthcare providers "could not be substantiated" or "did not widely affect access to healthcare".

The Israeli human rights organization B'Tselem calls on Israeli authorities not to make the settler, Yifat Alkoby a scapegoat for law enforcement failures in the West Bank . Alkoby was summoned for questioning following the extensive airing of a B'Tselem video in which she is seen assaulting and swearing at women and girls from the Abu-'Ayesha family, in Tel Rumeida, Hebron. The incident, as grave as it is, is only the tip of the iceberg of the daily violence committed by Hebron settlers, against their Palestinian neighbors, under the protection of the army.

The attacks in Hebron are carried out in full view of Israeli soldiers, who are unable or unwilling to stop them. The Hebron police, who have received hundreds of complaints about settler violence, are also well aware of the situation. The fact that the Defense Minister and the security establishment feign ignorance and mobilize to respond to the problem only following the public controversy generated by this video is outrageous.

The widespread settler violence in Hebron is not the result of a specific failure of one kind or another, but is the consequence of a consistent and longstanding Israeli policy to ignore harm to Palestinians, which is aimed at encouraging them to abandon parts of the city.

1DRM-buster DVD Jon has a new target in his sights, and it’s a big piece of fruit. He has reverse-engineered Apple’s Fairplay and is starting to license it to companies who want their media to play on Apple’s devices. Instead of breaking the DRM (something he’s already done), Jon has replicated it, and wants to license the technology to companies that want their content (music, movies, whatever) to play on Apple devices. This may not be good news for iTunes the store, but it could make the iPod even more popular.

Jon Lech Johansen became famous for hacking encrypted DVDs so they would play in Linux when he was 15, making him the target of criminal charges for which he was eventually acquitted. Last year he moved from Norway to San Diego to2 work for Michael Robertson3. But the work — a digital locker for music — didn’t captivate Johansen, so he struck out on his own at the beginning of the summer.

Twenty-two-year-old Johansen moved to San Francisco4 to work with Monique Farantzos, who had contacted him after reading a Wall Street Journal profile of him last fall. The two now live in the Mission District and devote their time to DoubleTwist Ventures5, which is Johansen’s first major attempt at commercializing his hacking. They haven’t raised any outside money because they have already found at least one (undisclosed) paying customer.

Johansen isn’t much of a swashbuckler; he barely touched his Heineken when we were out at drinks last week. But he has a lot of chutzpah, and related the story of how he emailed Steve Jobs and set up a lunch meeting in January.

Johansen and Farantzos went down to Cupertino for an audience with King Jobs, but weren’t terribly specific about their new company’s plans (to be fair, at this point, they didn’t quite know what their plans were). Jobs apparently warned that while Apple was not a litigious company, other tech firms might not take kindly to whatever DVD Jon might be up to. Ha!

Johansen doesn’t think what he’s doing is illegal; he’s adding DRM rather than breaking it. He and Farantzos were giddy about the prospect of Apple’s iTV, hoping companies will pay up to get movies on the set-top box when it comes out, after seeing the ill effects of being shut off the iPod. Spurned by Apple? Step right up.

This is a different twist on the constant battle between DRM crackers and builders (see, just last week, Microsoft’s lawsuit6 against a hacker for releasing an app that strips off its PlaysForSure DRM). If successful, DoubleTwist will eliminate Apple as a middleman to its own hardware. But in doing so, it just might help Apple sell more of that hardware. Apple enjoys fat margins on its devices, and perhaps should turn a blind eye, for now.

We won’t be crossing our fingers for Jobs to keep his non-litigious promise, though.

After yesterday's news that

Microsoft was launching a lawsuit campaign against the John Does responsible for FairUse4WM, we weren't expecting the next volley to come so soon. So it's somewhat contrary to expectations that Viodentia has released the newest version of his software to counter Microsoft's latest PlaysForSure IBX update (dated 9/23, regarding the memo which we recently printed). We asked Viodentia about Redmond's accusation that he and/or his associates broke into its systems in order to obtain the IP necessary to crack PlaysForSure; Vio replied that he's "utterly shocked" by the charge. "I didn't use any Microsoft source code. However, I believe that this lawsuit is a fishing expedition to get identity information, which can then be used to either bring more targeted lawsuits, or to cause other trouble." We're sure Microsoft would like its partners and the public to think that its DRM is generally infallible and could only be cracked by stealing its IP, so Viodentia's conclusion about its legal tactics seems pretty fair, obvious, and logical to us. An American megacorp swinging around bogus indictments in order to root out a hacker? Surely you jest!

SAN FRANCISCO - Google Inc. has added more video and other bonus features for users of its popular three-dimensional mapping software to unearth even more information about destinations around the world .

The latest innovations unveiled Wednesday are available to any computer with Google Earth software installed .

Google says more than 100 million copies of the software have been downloaded since it was first offered to the general public last year, making it one of the company's most successful products outside its industry-leading Internet search engine. The mapping software is free for Windows, Mac and Linux computers, although premium versions are available for sale.

Google Earth's latest attractions, activated by clicking on a "featured content" box, include online video of cities and popular tourist attractions provided by Discovery Networks and Turn Here, an Emeryville-based startup.

The federal government also is providing details about all 58 U.S. national parks, and the United Nations is supplying time-stamped images documenting the environmental decay in 100 areas, including the Amazon and Africa.

The latest Google Earth upgrades come three months after the Mountain View-based company expanded the satellite imagery used in the software to quadruple the amount of land covered, enabling about one-third of the global population to obtain an aerial view of their homes and neighborhood.

The new features aren't available through Google's mapping Web site .

By now, everyone knows what MySpace is--or at least, they think they do. The generally held assumption is that MySpace is a social networking site: "a place for friends," as their slogan puts it. In reality, MySpace is the next generation of marketing, advertising and promotion, exquisitely disguised as social networking. Simply put, MySpace.com is Spam 2.0.

Spam in Sheep's Clothing

On July 11th, 2006, Hitwise reported that MySpace had "surpassed Yahoo! Mail as the most visited domain on the Internet for US Internet users." Clearly, MySpace has become almost ubiquitous--everyone and their mom have a profile up, from the fourteen-year old girl next door to Madonna. Tom Anderson himself--one of the site's founders and every MySpace user's number one "friend"--has over 109 million pals with profiles, and that's just today; by next week that number could easily have increased by millions. What's interesting is that most users don't know that Tom Anderson is more of a PR scheme than anything else--the mascot designed to give a friendlier feel to a site created by a marketing company known for viral entertainment websites, pop-up advertising, spam, spyware, and adware.

Most users believe that MySpace started as some kind of fluke--a happy accident that began in Anderson's bedroom or garage--and many still don't wonder, know, or care about the site's real business history and model. Heralded as a haven of DIY self-expression, MySpace was actually created by executives whose backgrounds are anchored in spam and mass marketing, and who are tied to investment scandals. With his almost alternateen good looks, Tom Anderson has served as an exceptionally convincing distraction. The PR campaign is one of MySpace's two strokes of genius, brilliant, but not groundbreaking.

The real genius of MySpace lies in it's re-imagining and repackaging of spam. While most internet users expend time and energy attempting to keep it out, MySpace is spam that they actually invite in .

In late 2004, September 11th Families for Peaceful Tomorrows met with Women for Women International to discuss how Peaceful Tomorrows might partner with them in efforts to help Afghan women. This March, Peaceful Tomorrows officially partnered with Women for Women. Members of our organization, and their friends, are now sponsoring Afghan women from a region particularly affected by military intervention. Peaceful Tomorrows feels this project forwards our mission of acknowledging our common experience with all people affected by violence throughout the world.

Women for Women International was founded in 1993 to help women overcome the horrors of war and civil strife in ways that can help them rebuild their lives, families, and communities. Women for Women International launched its Afghanistan program in 2002 to help women support their families and equip them with the skills necessary to participate in the reconstruction of civil society. Programs are being implemented through a holistic, tiered approach to offer Afghan women economic security at a grassroots level through training on women's rights, leadership and job skills. They also provide direct aid and opportunities to start income-generating projects. The program operates in Kabul Province in several districts, including Khairkhana, Afshar, and Shari-naw, as well as the province of Wardak. The main office is in Qalai Fatullah.

In January, 2002, one month before the official ‘creation’ of September 11th Families for Peaceful Tomorrows, four 9-11 family members traveled to Afghanistan. The “War on Terror’ had begun, and Afghanistan was its epi-center. These four courageous family members had decided there must be alternative responses. They wanted to meet Afghan families who had also lost a loved one to violence. They wanted to put a human face and a life story to a tragedy that was then occurring on the other side of the world.

Therein lies the heart of Peaceful Tomorrows – reaching out to civilian casualties of war and violence, and recognizing them in ourselves.

Peaceful Tomorrows lobbied hard in Congress during the Spring of 2002 for the creation of an “Afghan Victims’ Fund”. The rationale was simple; Americans had been overwhelmingly generous and compassionate to our families in the months after 9-11. Ordinary Afghan civilians were also being hurt and killed in Afghanistan, through the US led military campaign. Wouldn’t an effective foreign policy aimed at fostering good will not only recognize that loss, but include compensation for Afghan civilian victims and their families?

Ultimately, guided by the leadership of Senator Leahy, $4.5 million was secured from USAID to provide assistance to families and communities affected by the US military campaign in Afghanistan. This assistance was allocated in the 2002 and 2003 appropriations bills. The funds were used for quick impact projects for war-affected communities in southern and eastern Afghanistan, in areas that were especially hard-hit by the US military actions.

Since that first trip, Peaceful Tomorrows has remained committed to helping provide assistance to Afghan civilians. Other members of Peaceful Tomorrows participated in three follow up delegations to Afghanistan. Each trip has helped further our understanding of the plight of ordinary Afghan families struggling after years of war, oppression, and military campaigns. In early 2005, Peaceful Tomorrows donated the remaining funds from our Afghan Sister Campaign to "Afghans For Tomorrow", to help purchase school supplies for Afghan children. As an organization, we also wanted to establish an on-going program for our work regarding Afghanistan.

The founding of "The Freedom Theatre" was inspired by the work of Arna Mer Khamis
The members of the "Freedom Theatre" Association wish to announce that we intend to rebuild the children's theatre in the Jenin Refugee Camp which was established by Arna Mer Khamis and was destroyed by the Israeli Army in 2002.

Arna was born in 1929 to Jewish parents in the land of Palestine before the creation of the State of Israel in 1948. She began a lifetime of campaigning for peace, justice and human rights in her homeland - which most often meant acting and speaking out uncompromisingly for the rights of the Palestinian people and against the Israeli occupation of the West Bank and Gaza Strip.

It was at the time of the Palestinian uprising, or "The Stone Intifada", in 1988 that Arna saw the need to establish centers in the Jenin refugee camp for children affected by the violence around them. She founded the organization "Care and Learning" to respond to their needs.
Jenin refugee camp was established in 1953, within the municipal boundaries of Jenin in the West Bank. The camp was set up by UNRWA to house Palestinian refugees who lost their homes as a result of the establishment of the State of Israel in 1948 which is known as the Palestinian Catastrophe "Nakbah".

In 1993 Arna was awarded "The Alternative Nobel Prize" in Sweden for her work. She used the award to build and finance a children's theatre in Jenin camp, "Arna's House". Arna, alongside with her son Juliano, taught a group of children from Jenin camp how to act and perform, enabling the children to "bring the sun back into the palace" as their first play was called. Two years later, Arna Mer-Khamis died after a lengthy struggle against cancer.

In 2002, the Israeli Army invaded Jenin Refugee camp. As a result of the 10 day invasion, the theatre was destroyed, so there was no place left for the children of Jenin camp to play and perform.

In August 2005, friends and colleagues of Arna, community leaders in Jenin Refugee Camp, and the local staff of a child rehabilitation centre met to set about recreating Arna's children theatre in Jenin camp in order to educate, encourage, and empower the children. The Freedom Theatre was born, aiming to provide the children of Jenin Camp with opportunities for a "real" childhood, creative means of expressing themselves, and some light and hope. In its rehabilitation role the theatre will also be used, in conjunction with the rehabilitation committee in Jenin, for speech therapy and various therapeutic drama programs and as a space for the committee to expand their work, rehabilitating disabled children.

The Freedom theatre Association calls upon relief and welfare organizations as well as social, political, educational, and cultural NGO's, and supportive individuals, to help us in our effort by donating funds, services, expertise and relevant materials. No donation is too small.

Tali Fahima was detained on 8 August 2004 and has since been held in prison under torture and in isolation. Following two months of interrogation by the General Security Services (GSS) and after approximately three months of administrative detention, ridiculous and baseless charges were filed against her. Tali is being persecuted because she challenged the walls and checkpoints, the very system of separation being built between Jews and Arabs in this country; because she came out against the policies of illegal assassinations; because she made contact with Palestinians based on solidarity and struggle against the occupation, and in the framework of humanitarian-educational activities.

Tali’s trial will be held from 17-19 July and 18-19 September 2005. The High Court ruled that she will be detained until the trial conclusion. Tali will sit in prison for at least 1.5 years (prior to the ruling) for all the things each one of us thought, did or wanted to do but did not have the courage.

Tali was held in isolation for more than nine months. Following her petition to the District Court she is no longer held in complete isolation, but is able to walk around for four hours daily in the wing in which she is held, and on weekends she is able to telephone her mother and attorney (the other female prisoners in jail are allowed to walk around all day and can use the public phone freely to speak with whomever they want).

Ever since Tali’s detention, the Israeli security authorities and judicial system have created the impression that Tali committed serious crimes against “state security” as she assisted in carrying out attacks, and that she is a danger to the public. The campaign against her borders on bloodletting.

Tali Fahima is a political activist. Out of political and human considerations she forged connections with Fatah members (the Al Aqsa Martyrs Brigades) in the Jenin refugee camp. In the wake of the Israeli assassination attempt against the organisation’s leader, Zachariah Zbeidi, Tali publicly declared in the past her willingness to act as his ‘human shield’. She visited the Jenin refugee camp several times and from May 2004 began to establish an enrichment programme (library and computer room) for the children of the camp, a goal thwarted by her arrest. All of Tali’s activities were done publicly and many of them were covered, at the initiative of Tali, by the Israeli press.

Tali Fahim is in prison, isolated and silenced. Her very activities amongst the Palestinians, her very identification with the Palestinian struggle to end the occupation, threaten the fundamental Israeli view that negates any type of struggle against the occupation. Her very presence in the Jenin refugee camp threatens the Israeli propaganda which equates the struggle against the occupation with the desire to annihilate Israel and the Jews – this view which produces terror and its ramifications; the view which builds settlements, demolishes homes and infrastructures, implements a policy of assassinations, builds walls and checkpoints.

On Sunday 30 January 2005, in the High Court in Jerusalem, Judge Eliyakim Rubenstein published his decision to accept the State’s appeal of the District Court ruling to move Tali Fahima to house arrest, and decided to remand her in custody until the conclusion of legal proceedings. Amongst other things, Rubenstein wrote that “before us is the dangerousness of a person who significantly identifies with an ideological goal, at a time when the border between expressing solidarity for acts of assistance was blurred and even erased; and so a person becomes “a prisoner of a goal” and this is “even if others could read the material”.

On 24 January 2005 Judge Gorfinkel of the Tel Aviv District Court decided to reject the state request to remand Tali to custody until the conclusion of legal proceedings and ruled that Tali should be moved to house arrest. Unlike the tens of other judges who ruled before him in the matter of Tali, it appears that Judge Gorfinkel was the first who actually carefully read the legal file and was not simply influenced by the State Attorney’s Office, which is unsupported by any evidence, and the GSS campaign of fear and threats. Judge Rubenstein reversed the decision and again closed ranks with the system.

On Sunday 26 December 2004, charges were brought against Tali involving “assistance to the enemy at time of war, providing information to the enemy for his benefit, contact with a foreign agent, possessing firearms with no legal authorization, support for a terrorist organization and the violation of a legal directive.” These frightening charges, conviction for which can lead to long years in prison, are based on the suspicion that Tali Fahima read and explained to Jenin’s Fatah activists a document left there by the Israeli army, and which documented an operation intended to kill or detain the “wanted persons” detailed in it. “In the wake of the explanations of the accused”, notes the charge sheet, “Zbeidi later ordered the wanted persons to hide until the conclusion of the military operation…the wanted persons, who carried out Zbeidi’s directive and hid, were not detained.” Tali was further charged with supporting a terrorist organization due to her statements in the press against the assassination of Zbeidi and declaration that she would serve as his ‘human shield’. More minor charges in the charge sheet refer to the contention that Tali held a rifle and fired one shot, in addition to her very entry into Jenin and the meeting with fighters in the camp. One does not need to be an expert in security to know that wanted persons do not need Tali Fahima to know that the Israeli army is searching for them, and certainly not to read military documents which fall into their hands. When one sees the “confidential document” which contains primarily pictures and aerial photos, it is unclear what needs to be read and and what needs to be explained.

Tali Fahima was detained on 9 August 2004 on her way to Jenin, and was subsequently questioned during a grueling 28 day GSS interrogation. The interrogation included sexual harassment, a filthy cell which was lit 24 hours a day, eye covering and painful cuffings. During the “interrogation”, the interrogators attempted to “make Tali into a good Jewish girl” (so they told her) and convince her that there is no occupation. Despite Tali’s repeated questions, they refused to tell her with what she was specifically charged. When no evidence against her was found, they placed her in administrative detention. For three months Tali was held in isolation in the Neve Tirza prison, a victim of abuse by the jailers who were the only people apart from her mother and attorney whom she was allowed to see. Almost one month of the three was spent by Tali in solitary confinement, during which she was punished and not allowed canteen privileges, cigarettes, personal items such as shampoo, toothpaste, letters and books. On 5 December, one day before the District Court hearing concerning the extension of her administrative detention, she was once again taken for three weeks of interrogation by the GSS. This interrogation also included torture and physical and mental abuse. In the first days of the interrogation, Tali’s hands were cuffed behind her to a chair, she was prevented use of the toilet and medical attention. At the conclusion of this interrogation a charge sheet was presented.

One time I was in Jenin, in 2002, a few months after the invasion. There was a lot of Israeli military activity still going on. One day myself and several other internationals (and locals) were taking cover in an alley as several armoured fighting vehicles, stationary in positions around the town centre, were basically shooting the place up by way of enforcing curfew. I was lying on some steps at the entrance to the alley, looking out to see what was happening. One tank was firing with a roof-mounted heavy machine gun directly at a stone wall opposite the entrance to the alley. It crossed my mind that perhaps they were trying to bounce rounds in at us, but as I looked I saw that there was some graffiti sprayed on the wall, right where the bullets were hitting. It was just basic written words, which I couldn’t read as I don’t have the Arabic. I don’t know if it was Anti Jewish, Pro-Intifada or whatever. But the gun was shattering and blasting at the stone, erasing the words with bullets. I don’t have a clear point to make here but it stuck in my mind anyway .

In a country of fewer than four million inhabitants, more than 25 per cent of them took to the roads as displaced persons. An estimated 500,000 people sought shelter in Beirut alone, many of them in parks and public spaces, without water or washing facilities.

Amnesty International delegates in south Lebanon reported that in village after village the pattern was similar: the streets, especially main streets, were scarred with artillery craters along their length. In some cases cluster bomb impacts were identified. Houses were singled out for precision-guided missile attack and were destroyed, totally or partially, as a result. Business premises such as supermarkets or food stores and auto service stations and petrol stations were targeted, often with precision-guided munitions and artillery that started fires and destroyed their contents. With the electricity cut off and food and other supplies not coming into the villages, the destruction of supermarkets and petrol stations played a crucial role in forcing local residents to leave. The lack of fuel also stopped residents from getting water, as water pumps require electricity or fuel-fed generators.

Israeli government spokespeople have insisted that they were targeting Hizbullah positions and support facilities, and that damage to civilian infrastructure was incidental or resulted from Hizbullah using the civilian population as a "human shield". However, the pattern and scope of the attacks, as well as the number of civilian casualties and the amount of damage sustained, makes the justification ring hollow. The evidence strongly suggests that the extensive destruction of public works, power systems, civilian homes and industry was deliberate and an integral part of the military strategy, rather than "collateral damage" – incidental damage to civilians or civilian property resulting from targeting military objectives.

Statements by Israeli military officials seem to confirm that the destruction of the infrastructure was indeed a goal of the military campaign. On 13 July, shortly after the air strikes began, the Israel Defence Force (IDF) Chief of Staff Lt-Gen Dan Halutz noted that all Beirut could be included among the targets if Hizbullah rockets continued to hit northern Israel: "Nothing is safe [in Lebanon], as simple as that,"(8) he said. Three days later, according to the Jerusalem Post newspaper, a high ranking IDF officer threatened that Israel would destroy Lebanese power plants if Hizbullah fired long-range missiles at strategic installations in northern Israel.(9) On 24 July, at a briefing by a high-ranking Israeli Air Force officer, reporters were told that the IDF Chief of Staff had ordered the military to destroy 10 buildings in Beirut for every Katyusha rocket strike on Haifa.(10) His comments were later condemned by the Association for Civil Rights in Israel.(11) According to the New York Times, the IDF Chief of Staff said the air strikes were aimed at keeping pressure on Lebanese officials, and delivering a message to the Lebanese government that they must take responsibility for Hizbullah’s actions. He called Hizbullah "a cancer" that Lebanon must get rid of, "because if they don’t their country will pay a very high price." (12)

The widespread destruction of apartments, houses, electricity and water services, roads, bridges, factories and ports, in addition to several statements by Israeli officials, suggests a policy of punishing both the Lebanese government and the civilian population in an effort to get them to turn against Hizbullah. Israeli attacks did not diminish, nor did their pattern appear to change, even when it became clear that the victims of the bombardment were predominantly civilians, which was the case from the first days of the conflict.

International humanitarian law and war crimes

International humanitarian law governs the conduct of war, and seeks to protect civilians, others not participating in the hostilities, and civilian objects. In an armed conflict, military forces must distinguish between civilian objects, which may not be attacked, and military objectives, which, subject to certain conditions, may be. The principle of distinction is a cornerstone of the laws of war.

Military objectives are those that: "by their nature, location, purpose or use make an effective contribution to military action and whose total or partial destruction, capture or neutralization, in the circumstances ruling at the time, offers a definite military advantage." Civilian objects are "all objects which are not military objectives". Objects which are normally considered "civilian objects" may, under certain circumstances, become legitimate military objectives if they are "being used to make an effective contribution to military action". However, in case of doubt about such use, the object must be presumed to be civilian.

Direct attacks against civilian objects are prohibited, as are indiscriminate attacks. Indiscriminate attacks are those which strike military objectives and civilian objects without distinction. One form of indiscriminate attack is treating clearly separate and distinct military objects located in a city, town, village or concentration of civilians, as a single military objective. If two buildings in a residential area are identified as containing fighters, bombardment of the entire area would be unlawful.

Disproportionate attacks, also prohibited, are those in which the "collateral damage" would be regarded as excessive in relation to the direct military advantage to be gained. Israel maintains that the military advantage in this context "is not of that specific attack but of the military operation as a whole".(13)

This interpretation is too wide. Overbroad interpretations of what constitutes a military objective or military advantage are often used to justify attacks aimed at harming the economy of a state or demoralizing the civilian population. Such interpretations undermine civilian immunity. A legitimate military advantage cannot be one that is merely "a potential or indeterminate advantage". If weakening the enemy population’s resolve to fight were considered a legitimate objective of armed forces, there would be no limit to war.

Israel has launched widespread attacks against public civilian infrastructure, including power plants, bridges, main roads, seaports and Beirut’s international airport. Such objects are presumed to be civilian. Israeli officials told Amnesty International that the potential military use of certain items, such as electricity and fuel, renders them legitimate military targets. However, even if it could be argued that some of these objects could qualify as military objectives (because they serve a dual purpose), Israel is obligated to ensure that attacking these objects would not violate the principle of proportionality. For example, a road that can be used for military transport is still primarily civilian in nature. The military advantage anticipated from destroying the road must be measured against the likely effect on civilians, especially the most vulnerable, such as those requiring urgent medical attention. The same considerations apply to electricity and fuel, among other items.

Similarly critical is the obligation that Israel take "constant care to spare civilians, the civilian population, civilian objects, from attack". This requirement to take precautionary measures in launching attacks includes choosing only means and methods of attack "with a view to avoiding, and in any event to minimizing, incidental loss of civilian life, injury to civilians and damage to civilian objects".

It is also forbidden to use starvation as a method of warfare, or to attack, destroy, remove or render useless objects indispensable to the survival of the civilian population. Some of the targets chosen – water pumping stations and supermarkets, for example – raise the possibility that Israel may have violated the prohibition against targeting objects indispensable to the survival of the civilian population.

Israel has asserted that Hizbullah fighters have enmeshed themselves in the civilian population for the purpose of creating "human shields". While the use of civilians to shield a combatant from attack is a war crime, under international humanitarian law such use does not release the opposing party from its obligations towards the protection of the civilian population.

Many of the violations examined in this report are war crimes that give rise to individual criminal responsibility. They include directly attacking civilian objects and carrying out indiscriminate or disproportionate attacks. People against whom there is prima facie evidence of responsibility for the commission of these crimes are subject to criminal accountability anywhere in the world through the exercise of universal jurisdiction.

The damage to the infrastructure

The long-term impact of the destruction of Lebanon’s infrastructure on the lives of the country’s men, women and children is incalculable. Many have lost their homes while having to cope with the deaths of loved ones or struggling to overcome severe injuries. Many more have lost their livelihoods. Records showing home and property ownership have been destroyed, adding to the difficulties of rebuilding lives.

The head of the country’s Council for Development and Reconstruction, Fadl Shalak, said on 16 August that the damage incurred amounted to US $3.5 billion: US $2 billion for buildings and US $1.5 billion for infrastructure such as bridges, roads, and power plants.(14) A survey compiled by the Council, based on on-site inspections in central and northern Lebanon and telephone calls to engineers and municipal officials in the south, showed the worst damage to the road network, with more than 120 bridges destroyed (a significantly higher figure than that reported by the government). Fadl Shalak said that replacing the bridge connecting Mount Lebanon to the Bekaa Valley above the Sulfi River on the road to Damascus would cost an estimated US $65 million. "A beautiful bridge, its columns 70 meters, it’s one of a kind in the whole Middle East. Why would they destroy such a bridge?" he asked. "They could have bombed the beginning and the end and stopped the traffic. But they made a point to bomb this bridge several times."(15) Another observer said, "This bridge is not used by Hizbullah since it lies in a mountain resort area of Mount Lebanon, far away from the south of Lebanon. Hence it has no strategic value for the Israeli fight against Hizbullah. But it was a beautiful bridge and was the symbol of the reconstruction of Lebanon after the civil war."(16)

We strongly condemn all aggressive acts by the Israeli army in Gaza and Lebanon with tragically consequences for the live of the Palestinian, Lebanese and Israeli people but also for people from other countries.

We reject and condemn the blames and threats by U.S and Israeli government addressed toward Syria and Iran and against other countries of the region. These threats reveal that the real aggressive and expansive force in the region is Israel.

We strongly protest the US policy which encourages the Israeli aggressiveness. We reject the hypocrisy shown by the G8 leaders andthe “equal distance” policy pursued today by certain forces.

We are highly concerned about and warn of the great dangers for a general spread of the crisis in the Middle East, for a new civil war and for a massive imperialist intervention in Lebanon under the pretext of “peace building measures”.

Only pulling out Israeli soldiers from Gaza and Lebanon and a just and viable peace would put an end to the bloodshed and guarantee the security for all peoples of the Middle East.
